Biography
Gunn, Lee & Jackson, Houston, Texas, 1977–1988
After graduation from law school, joined a small IP boutique in Houston. Clients ranged from individuals to privately owned companies. Engaged in IP litigation including preliminary injunction hearings punctuated by occasional trials and appeals in state and federal courts in Texas, Florida, Washington, and Louisiana. Disputes included breach of license agreements, trade secrets, common law trademarks, patent infringement, federal trademark infringement, and copyright infringement. Successfully negotiated and settled many cases. Prepared and prosecuted patent applications in sufficient numbers to become a registered patent attorney before the U.S. Patent and Trademark Office. Joined the firm as a law clerk and progressed to partner.
Herzog & Crebs, St. Louis, Missouri, 1988–2000
Moved to St. Louis and joined a medium sized general practice firm to start the IP department from scratch. Clients included privately and publicly owned companies and leveraged buyouts. Managed the IP department as it grew to include a total of four registered patent attorneys, two trademark attorneys, and two IP paralegals. My practice transitioned from litigation to business transactions, including answering IP questions from the general attorneys in the firm. Negotiations of all sorts, client counseling, licensing, product clearance, evaluation of IP portfolios for acquisition, freedom to operate opinions, patent and trademark clearance, preparation and prosecution, domestic, and abroad. Continued some litigation including licensing disputes, trade dress disputes, patent and trademark infringement, and trade secret disputes in Missouri, Kansas, Illinois, and Ohio. Represented clients in binding arbitrations, mediations, and an early neutral evaluation. Argued trademark registration issues before the Trademark Trial and Appeal Board. Joined the firm as an associate and progressed to partner.
Husch Blackwell Sanders, St. Louis, Missouri, 2000–2008
Joined a general practice firm that is one of the top 100 largest firms in America. Clients ranged from privately owned companies to multi-nationals, including the world's largest retailer. Business transactions including negotiations, client counseling, development of portfolio strategies, licensing, freedom to operate opinions, assessment of IP portfolios for private equity investors, product clearance, patent and trademark clearance, preparation, and prosecution on a worldwide basis. Appeared and successfully argued before the European Patent Office in Munich, Germany. Managed IP litigation handled by the litigation department. Certified mediator and successfully resolved several third party IP disputes. Successfully advised and assisted companies to downsize their IP portfolios. Joined the firm as a partner.
